EEOC Charge Alleges David Weimer Hired Sex Offender Who Sexually Harassed Employee

Weimer-Keyser-photo-1-300x225A West Virginia woman has filed an EEOC charge alleging that she was sexually harassed by David Arbaugh while working for David Weimer, and Weimer Keyser, Inc. The following is quoted directly from the Charge allegations:

David Arbaugh worked as the General Manager of Respondent’s Moorefield location until he was led out in handcuffs. …. Arbaugh was caught exchanging sexual messages and photos with a 16-year-old girl, which were reported to the Center for Missing and Abused Children and then County Prosecutors.

Arbaugh was initially permitted to reside at home on a personal recognizance bond, however the Moorefield Examiner reported on June 9, 2021 []  that the Court revoked Arbaugh’s bail and remanded him to jail for calling the minor victim. The Examiner reported that the Court held that:

the $10,000 personal recognizance bond was “unconscionable” given the nature of the alleged crime. [Judge] Williams ordered Arbaugh held at Potomac Highlands Regional Jail until the matter is presented to the Hardy County Grand Jury on June 22.

After pleading guilty, Arbaugh was given a two-to-ten-year prison sentence, was required to register as a sex offender for life, and was subject to supervision by the Department of Probation for 15 years after release. The Moorefield Examiner reported on Arbaugh’s appearance to plead guilty on January 26, 2022, writing that “Arbaugh . . . solicited the juvenile to engage in sexual activities, . . .” “I knew her,” he said. “I initiated the contact.” Statements of Prosecutor and David Arbaugh at his Plea Hearing. Although at Arbaugh’s sentencing hearing the prosecutor stated in open Court that “[h]e sent her text messages that are too disgusting to read on the record” . . . less than four months into his sentence, Respondent David Weimer supported Arbaugh’s petition for early release . . , claiming that:

Defendant will have employment available at Weimer Volkswagen or Weimer Hyundai in Morgantown, West Virginia. It is unknown whether those job opportunities will remain available if Defendant serves his sentence as presently ordered.

The petition cited “Defendant’s prior model conduct on home incarceration . . . ” even though the Court had revoked Arbaugh’s bail and remanded him to jail for calling his victim . . .

Complainant began working at the Keyser, West Virginia location of Respondent Weimer Automotive Group in March 2024.

When Arbaugh was released from prison the following month, Weimer’s Moorfield employees were too frightened and would not allow Weimer to return him to the Moorefield dealership. David Weimer rehired Arbaugh as General Manager of his Keyser location “in the hopes he would be less known to that community.” This made him Complainant’s General Manager and the most senior Weimer manager at the Keyser dealership.

In an attempt to ease Keyser employees’ fear, David Weimer told [a long time senior manager] that “what [Arbaugh] did wasn’t terrible and that the only reason he got in trouble was because of a picture” on his phone. []

David Weimer re-hired Arbaugh even while by design, he maintained no policy against sexual harassment or means by which employees could complain without fear of retaliation. In her sworn statement….Weimer’s former longtime [senior manager], said: “I pushed David Weimer to make an Employee Manual. David Weimer said he couldn’t have one because then he would have to follow it.” [] This was not a mistaken failure to comply with the law, this was the deliberate creation of a serious obvious danger to all women coming in contact with Arbaugh… [Arbaugh’s] picture in a Weimer Automotive shirt was posted online as a warning of the danger he poses to the community.

Once his parole ended in April 2025…[Arbaugh’s] sexual threats of serious harm and physical sexual abuse of Complainant became a daily occurrence. He sent her a text message [claiming she wanted to be intimate with him. When she disagreed he said] “That’s why they made duck tape and meds.”

During the first week of January 2026, while Complainant was getting ready to leave work for her wedding anniversary celebration, Arbaugh called her on her phone and said, “Come back to the bay area. Stay on your phone.” He was waiting for her in a dark, deserted corner of the back bay area where employees wash cars. He told Complainant, “If you tell [the long time senior Manager] what I’ve told you, I will call your husband and tell him that I [f*****] you on your desk.”

When Complainant turned around to leave, Arbaugh struck her rear end with such force that he left a bruise. With zero option to complain to her employer, David Weimer, her only alternative was pleading with Arbaugh himself in a text message not to threaten her marriage and further molest her.

In her sworn statement…of January 20, 2026, Claimant’s former coworker [] states that:

  1. Recently, when I was at the Keyser location, I witnessed Arbaugh smack [Complainant’s] behind. I saw him put his hand on her breast as he was walking behind her.
  2. After he did this to her, he came over to me and picked me up off the floor, so our bodies were front to front. I was shocked and extremely uncomfortable by his aggressive behavior. Our supervisor….witnessed what he did to both [Complainant] and me.

When Arbaugh knew she was at a cabin with her husband celebrating their wedding anniversary, Arbaugh left Complainant a voice mail message stating that:

Hey, I’m out here with the camera in the woods like you told me to video you and [husband], but you need to open the curtain I can’t quite see into the hot tub. So, if you can do that, I’ll make sure then I’ll get your video up on the internet you wanted me to do. Bye.

Arbaugh’s sexually harassing actions and statements towards Complainant also included, but were not limited to:

  • You should leave your husband
  • We would be good in bed together . . .
  • Referring to [a female coworker]: The only reason I hired her is to see her t*ts
  • Threatening to take Complainant and [a second female coworker] into the supplies closet to have sexual intercourse . . .
  • When anyone told Complainant that she looked nice, saying ‘I helped her dress this morning’
  • Asking Complainant to come with him to a back closet where there were no cameras, pretending it was for work, and when he came out, adjusting his pants in the crotch area implying they had sex.

These are only examples; there were more comments, and constant unwanted touching, as attested under oath by witnesses. [Complainant’s supervisor] witnessed how severely this affected [Complainant]:

His frequent aggressive advances towards [Complainant] caused her tremendous stress at work. She would often have to sit and breathe to calm herself down from these frequent incidents. She would go into panic mode whenever he was around, not knowing what he would do or say to her. This kind of behavior from Arbaugh and given his criminal history is completely unacceptable and in any workplace. I don’t understand how owner David Weimer brought him back in any capacity, let alone as General Manager.

The foregoing are allegations and have not been proven in a court of law.
